Position Overview
We are seeking a skilled Special Education Litigation Attorney to represent students, families, school districts, and public agencies in administrative and court proceedings involving special education and civil rights law. The attorney will litigate IDEA and Section 504 disputes, handle OCR and Title IX complaints, advise clients on FAPE, IEP compliance, LRE, ADA obligations, and develop strategies to achieve positive outcomes through hearings, motion practice, appeals, and alternative dispute resolution.
Key Responsibilities
- Represent clients in administrative due process hearings under the Individuals with Disabilities Education Act (IDEA) and Section 504 proceedings.
- Initiate and defend civil litigation in state and federal court, including drafting complaints, answers, motions, briefs, and appellate filings.
- Prepare and prosecute OCR (Office for Civil Rights) complaints and respond to OCR investigations and inquiries.
- Advise clientsstudents, parents, school districts, and public agencieson IEP development, FAPE requirements, Least Restrictive Environment (LRE), ADA compliance, and Title IX obligations.
- Conduct case intake, legal research, factual investigation, witness preparation, and expert engagement to develop litigation strategy.
- Attend and participate in IEP meetings, mediations, settlement negotiations, and alternative dispute resolution (ADR) forums to resolve disputes efficiently when appropriate.
- Work collaboratively with educators, advocates, experts, and agency personnel to analyze policies, evaluate programs, and recommend legally compliant practices.
- Manage a caseload including calendaring deadlines, maintaining client communications, and preparing hearing and trial exhibits.
- Draft policies, training materials, memoranda, and legal opinions for school districts and public agencies regarding special education and civil rights issues.
- Supervise junior attorneys, paralegals, and support staff as required and maintain high standards for case management and ethical practice.
Qualifications
- Juris Doctor (J.D.) from an accredited law school and admission to practice in the relevant state bar.
- Minimum 3 years of litigation experience; experience specifically in special education, IDEA, Section 504, or education law strongly preferred.
- Demonstrated experience with administrative hearings, federal district court litigation, and appellate practice.
- Deep knowledge of IDEA, IEP requirements, FAPE, Section 504, ADA, Title IX, OCR processes, and civil rights law affecting students with disabilities.
- Proven skills in legal research, writing, motion practice, and oral advocacy in both administrative and judicial forums.
- Experience working with school districts, public agencies, families, and advocacy organizations; familiarity with educational procedures and school operations preferred.
- Track record handling alternative dispute resolution, mediation, and settlement negotiations in education disputes.
- Excellent communication and interpersonal skills, with the ability to explain complex legal concepts to non-lawyers and build effective client relationships.
- Strong organizational skills and ability to manage a diverse caseload, meet deadlines, and maintain meticulous case files.
- Ability and willingness to travel for hearings, meetings, and depositions; valid drivers license.
